Where a party requests the charging of lawyers` fees, the party must demonstrate that its claim is appropriate, which means that the time spent by its lawyers in the case was reasonable with regard to the questions of law and law at issue and that the hourly rates of its lawyers are applied in the Community, in the case, are appropriate. The party at the other end of the application obviously has the right to challenge the royalty claim. When such a challenge occurs, the moving party may retaliate by requesting disclosure of the opposing party`s attorneys` fees in the case. This is usually done for two reasons: (1) to attempt to remove the opposing party by creating the risk of finding their own attorneys` fees, and (2) to argue to the court that the best evidence of what is reasonable is what the opposing party paid to deal with the same legal and actual issues in the case.
